Does Florida Accept Out of State Medical Cards?

For medical marijuana cardholders, figuring out how to travel with cannabis can get pretty complicated pretty quickly. Since medical cannabis isn’t legal in all 50 states yet, it’s not as easy as packing a bag with your MMJ medication and supplies. Attempting to cross state lines with cannabis—especially on a plane, train, or public bus—can end up landing you in a heap of legal trouble. Since marijuana is still classified as a Schedule I, federally illegal substance, laws forbid anyone to transport it across state lines.

What is Medical Marijuana Reciprocity?

Depending on your destination, you may be able to use your medical marijuana card to get temporary access to medical cannabis in that state. For instance, some states have recently created “reciprocity agreements,” in which out-of-state MMJ cardholders are recognized for use while visiting. Beyond expanding critical access to medical cannabis for cardholders, reciprocity helps support economic growth within the state, making it a win-win situation.

Unfortunately, medical marijuana laws are still evolving in some parts of the United States. With all the differences between cannabis laws between states, travel can be confusing for MMJ patients. That is why we’re here to help break down the basics for you.

Can a Tourist Get a Temporary Medical Card in Florida?

Currently, Florida cannabis laws state that medical marijuana cards are only available for qualifying Florida residents. Under these regulations, a resident must meet the following requirements to receive an MMJ card:

  • Be at least 18 years of age; or, if a minor, have the written consent of a parent/garden and be diagnosed with a terminal illness
  • Be a full-time or seasonal Florida resident (temporary or permanent residency)
    • A “seasonal resident” (temporary residency) must live in Florida for at least 31 consecutive days in each calendar year, return at least once yearly, is registered to vote/pays taxes in another state, and can provide documentation to show proof of residence
  • Have a qualifying health condition (diagnosed by a certified physician) that cannot be effectively treated using other medications, such as:
    • ALS
    • Cancer
    • Crohn’s disease
    • Epilepsy
    • Glaucoma
    • HIV/AIDS
    • Multiple Sclerosis (M.S.)
    • Parkinson’s Disease
    • PTSD

So, the short answer to this question is no; a tourist cannot get a medical marijuana card in Florida.
However, suppose you will be living in Florida for at least 31 days/calendar year and maintain a temporary residence. In that case, you may be able to receive an MMJ card as a seasonal resident.
If you’re planning to make a permanent move to Florida and already have a medical marijuana card in your state, transferring your benefits could also be an option.

  • The first step in the process for getting an FL MMJ card is to determine if you qualify. Next, you’ll need to see a qualifying physical and be diagnosed with one of the medication conditions approved under the state’s regulations. Then, your doctor will submit your information to the Medical Marijuana Use Registry. At that point, you can complete your application for a medical marijuana use I.D. card.

What counts as medical marijuana under F.L. law?

  • In Florida, legal medical marijuana is cannabis purchased by a certified patient at a licensed MMJ dispensary. Medical cannabis includes all parts of the Cannabis plant and any products made from the plant, including low-THC cannabis products. So, what does this mean for you? Under Florida law, MMJ cardholders can only legally purchase cannabis at Florida-certified dispensaries (called medical marijuana treatment centers or MMTCs). Cannabis purchased anywhere else is not considered medical marijuana, and you can be penalized.
